Legalizing a basement suite in BC requires meeting specific BC Building Code requirements and obtaining a building permit from your municipality. Many homeowners have existing basement suites that were built without permits and do not meet current code. Legalizing these suites protects you from fines, ensures tenant safety, and may be required for insurance coverage. The BC Building Code requires a minimum ceiling height of 1.95 metres (6 feet 5 inches) in all habitable rooms. If your basement has lower ceilings, underpinning (lowering the basement slab) is the most common solution. We have extensive experience with underpinning projects across the Lower Mainland. Every bedroom must have an egress window with a minimum opening area of 0.35 square metres and no dimension less than 380 millimetres. Many older basements need window enlargement, which involves cutting into the foundation wall and installing a new window well. Fire separation between the suite and the main dwelling is mandatory. This includes fire-rated drywall assemblies (typically 5/8-inch Type X drywall), a self-closing fire-rated door if there is a shared corridor, and interconnected smoke alarms in both units. Carbon monoxide detectors are also required if there are fuel-burning appliances. A separate entrance from the outside is required. The suite must have its own dedicated electrical sub-panel, separate heating and ventilation, and plumbing that meets current code including proper drainage and venting. Under BC's Bill 44 (effective June 30, 2024), all municipalities must allow secondary suites in single-family zones. This legislation has streamlined the path to legalization across the Lower Mainland.
